Privacy Policy

We are very delighted that you have shown interest in our company. Data protection is a high priority for the management of TBH GmbH. The use of TBH web pages is possible without any indication of personal data; however, if a data subject wants to use special company services via our website, processing of personal data could become necessary. If the processing of personal data is necessary and there is no statutory basis for such processing, we generally obtain consent from the data subject.

Thank you for visiting our website. The safe handling of your data is particularly important to us. Therefore, we would like to inform you about the use of your data when visiting our website.

Legal basis of processing

Art. 6(1) lit. a GDPR serves our company TBH GmbH as legal basis for processing operations in which we obtain consent for a specific processing purpose. If processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6(1) lit. b GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which processing of personal data becomes necessary, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, processing of personal data might become necessary to protect vital interests of the data subject or another person, Art. 6(1) lit. d GDPR. Finally, processing operations could also be based on Art. 6(1) lit. f GDPR. Processing operations that are not captured by any of the legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights, and freedoms of the data subject are not overridden.

Transfer of data

We do not transfer your personal data to third parties for purposes other than those listed below. We will only disclose your personal data to third parties if:

  • you have given your express consent to do so in accordance with Art. 6(1) lit. a GDPR,
  • the disclosure is required under Art. 6(1) lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to believe that you have an overriding legitimate interest in the non-disclosure of your data,
  • if there is a legal obligation for disclosure pursuant to Art. 6(1) lit. c GDPR, as well as
  • this is legally permissible and necessary according to Art. 6(1) lit. b GDPR for the processing of contractual relationships with you.

Data subject rights

You have the right to:

  • according to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • according to Art. 16 GDPR, to request the correction of incorrect or incomplete personal data stored by us without undue delay;
  • according to Art. 17 GDPR, to request the erasure of your personal data saved by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise, or defense of legal claims;
  • according to Art. 18 GDPR, to request the restriction of processing your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing according to Art. 21 GDPR;
  • according to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common, and machine-readable format or to request that it be transferred to another data controller;
  • according to Art. 22 GDPR, not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning you or similarly significantly affects you;
  • according to Art. 7 (3) GDPR, to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing, which was based on this consent; and
  • according to Art. 77 GDPR, you have the right to complain to a supervisory authority, without prejudice to any other administrative or judicial remedy. You can contact the supervisory authority of your main residence or workplace or the place of the alleged infringement for this purpose, if the data subject believes that the processing of personal data concerning that person violates the EU General Data Protection Regulation (GDPR).
